2. DEFINITIONS & INTERPRETATIONS

In these Terms and Conditions, unless the context otherwise requires, the following expressions have the following meanings:

Service Provider Means Believe & Achieve Coaching Academy Ltd.
The CONSULTANT Means Catherine Earl (on behalf of Believe & Achieve Coaching Academy Ltd.)
Service(s) Means services provided by us / purchased by you as described in these Terms and Conditions
Programmes(s) Means the specific service(s) offered by us / purchased by the CLIENT
Online Course(s) Means Self Study programme(s) provided online by us / purchased by the CLIENT
Coaching Service(s) Means service(s) where the CONSULTANT directly engages with the CLIENT
We/Us/Our Believe & Achieve Coaching Academy Ltd. / the CONSULTANT
The CLIENT Means the person engaging the service(s) (you)
You / Your / They / Them / Their Means the CLIENT
Price / Fees Means the price payable for the service provided by the service provider
T&Cs Means these Terms and Conditions

3. GENERAL 

  • By paying for the services the CLIENT agrees to these Terms and Conditions
  • All material is copyrighted and cannot be shared by the CLIENT with anyone else.
  • All information provided by the CLIENT will be kept strictly confidential by the Service Provider / CONSULTANT.
  • The CLIENT understands that coaching is not advice, psychotherapy, other therapy or counselling and those professional referrals will be given if needed.
  • The CLIENT enters into the services with the understanding & acceptance that they are responsible for creating their own results.
  • The different types of services available to the CLIENT are described in this agreement.
  • The service provided to the CLIENT is relevant solely to the type of service purchased by the CLIENT.
  • The success of the service(s) is based on the CLIENT applying the materials and following the programme(s) as suggested in full.
  • Service(s) commence(s) upon completion of payment by the CLIENT for the relevant service(s)
  • The CLIENT may not transfer their access to the services to another party without the express agreement of the CONSULTANT. Online credentials cannot be transferred to another party.
  • Prices / fees are inclusive of taxes where applicable

 4. ONLINE COURSES

  • Online courses are purchased online by the CLIENT at the price stated.
  • The CLIENT understands these are self-study programmes without personal input from the CONSULTANT/Service Provider.
  • The CLIENT is entitled to contact the CONSULTANT via email for guidance on the course process.
  • The CLIENT is entitled to a discovery call with the CONSULTANT to explore other coaching services.
  • Service(s) commence(s) upon full payment by the CLIENT for their chosen online course(s).
  • If CLIENT has not accessed any of the online materials, a refund can be given up to 14 days from date of payment. Refund is subject to bank charges incurred by the Service Provider. Once material has been downloaded, no refund is available to the CLIENT.
  • The CLIENT will have ongoing access to the online materials relating to the online course(s) they purchased.
  • The CLIENT accepts that they are responsible for creating their own results.

5. COACHING SERVICES 

  • The service provided to the CLIENT by the CONSULTANT is coaching, as agreed jointly with the CLIENT.
  • In order for the coaching partnership to achieve the maximum result, the CLIENT agrees to the following:
  • Attend all appointments and calls on time. 48 hour notice is required to reschedule.
  • Be honest and participate fully. Recognize that the sessions are a safe place to look at what the CLIENT really wants, and what it will take to make it happen.
  • The CLIENT commits to completing all their assignments and action plans they create, and do what they have agreed to do.
  • The CLIENT understands and accepts that the power of the coaching partnership can only be granted by the CLIENT, and the CLIENT commits to making the relationship powerful. 

5.1 THINKING into RESULTS®

5.1.1 Lessons

The Thinking Into Results® program is presented in twelve practical lessons

  • Lesson 10: The Most Valuable Person
  • Lesson 11: Leaving Everyone with the Impression of Increase

5.1.2 Coaching & Materials

  • Digital Participants Guide
  • Access to daily online training videos & worksheets
  • Weekly Group Sessions with CONSULTANT via zoom (1 hour), unless agreed otherwise
  • Bi-weekly one on one coaching session with the CONSULTANT (30 minutes), unless agreed otherwise

Throughout the coaching partnership, the CONSULTANT will engage in very direct and personal conversations with the CLIENT, which will include asking explicit questions and making direct requests.

The purpose of these interactions is to remind the CLIENT of their own intentions and coach them to realize them.

The CLIENT understands & accepts that they are responsible for creating their own results.       

5.1.3 Price & Payment:

Investment for Thinking into Results Programme: GBP8,000 per person for 6 months.

Payment plan is available and as agreed between the CLIENT and the CONSULTANT prior to commencement of the coaching services.

  • Fees are collected prior to commencement of the coaching services as per agreed payment plan.
  • CLIENT agrees to pay any and all instalments in full once coaching services have commenced.
  • Commencement of the coaching services is deemed to be when the CLIENT has paid the fees as per the agreed payment plan, has received their log in credentials for the online materials and has either attended their onboarding call or has received their onboarding video.
  • Part of the CONSULTANT’s role is to hold the CLIENT accountable and help the CLIENT achieve their goals. This means that once the CLIENT has accessed the coaching services (accessed digital materials and/or attended their onboarding session and/or received their onboarding video and/or attended a group session), no refund is available.
  • If the CLIENT has not accessed any of the coaching services (digital materials or onboarding or group sessions) a refund can be given up to 14 days from date of payment. Refund is subject to administrative fees of GBP250 plus any bank charges that may be incurred by the Service Provider..
  • The coaching services run for 6 months.
    • The CONSULTANT understands & accepts that there may be slight delays from the CLIENT side, and a one month grace period is allowed. Maximum time to access the coaching services is 7 months.
    • The CLIENT understands and accepts that due to unforeseen circumstances (for instance illness) the CONSULTANT may not be able to perform the services in a timely manner. The CONSULTANT will do their utmost to provide alternative solutions (for instance pre-recorded video facilitation). A one month grace period is allowed. Should the CONSULTANT be unable to provide agreed services after the grace period, a pro-rata refund will be given for clients who paid in full at the start of the programme. For clients on a payment plan, no refund applies, but no further instalments would be due.
  • The CLIENT will have ongoing access to the digital materials after the 6 months of CONSULTANT’s coaching, as long as full payment has been received.
  • All funds will be deemed earned by CONSULTANT as soon as they are received from CLIENT.
  • The CONSULTANT / Service Provider has the right to suspend the CLIENT’s access to the digital materials if instalment payments are not received in time from the CLIENT.

 6. OTHER COACHING SERVICES

  • Individual coaching services are available in blocks of 5 or 10.
  • Fees are agreed prior to commencement of those services and payable in full prior to the first session.
  • Refund can be given up to 14 days from date of payment, prior to the CLIENT attending their first session, subject to bank charges incurred by the Service Provider.
  • Once the CLIENT has attended their first session, no refund is available.
